No injury compensation for biker hurt in collision

A motorcyclist who was badly hurt in a road accident in December 2004 has had his attempts to claim injury compensation blocked by London’s court of appeal.

David Brown, 58, suffered serious leg injuries when a BMW collided with his bike at the junction of the S420 and West Littleton Road in Marshfield, the Bath Chronicle reports.

He also sustained a head injury and fractures to his right ankle and ribs, as well as soft tissue injuries to his neck and right shoulder, all of which have required him to undergo a series of operations.

However, Lord Justice Richards, sitting with Lord Justice Mummery and Lord Justice Rimer, rejected claimed that the driver of the car was in breach of the Highway Code, meaning Mr Brown will be unable to seek injury compensation.
