Accident Circumstances: our client was parked in the Morrison’s car park in Stoke on Trent when the defendant tried to park his vehicle in the next bay but hit our client’s rear bumper. The defendant then reversed out of the space again but this time struck our client’s rear wheel arch. At the same time this was occurring our client was trying to alight her vehicle and as a result of the collisions she suffered personal injury.

Client’s Injuries: Meniscal tear to the right knee requiring surgery, sore back and a a few minor bruises.

What did Hayward Baker Solicitors do to help: One of our personal injury specialists Alison Spriggs who is a Fellow of the Institute of Legal Executives took on the case on a no-win-no-fee basis and sent a letter of claim to the defendant, who admitted liability for the accident.

Our client was suffering extreme pain in the right knee so a consultation was arranged with an Orthopaedic Consultant who recommended surgery.  After surgery physiotherapy was arranged to aid recovery. Once treatment was completed Alison arranged for our client to be examined by a medical expert who subsequently formulated a report upon our client’s injuries. It was the prognosis within this report that Alison used to value the claim and to show the defendant insurers the extent of the injuries our client sustained.

Our client was self employed and as a result of the accident suffered a profit loss, required help and assistance around the home, incurred medical and travelling expenses. All of the aforementioned items were recorded by Alison  in our client’s claim for Special Damages (Out of Pocket Expenses) which formed part the claim.

Also contained within the Special Damages Schedule was a claim for future losses caused by the need for knee replacement surgery in the future.

Due to the injuries sustained our client’s case took some time to settle so the anniversary date  of the 3 year  time period in which our client had to make her claim was approaching, therefor  Alison issued protective proceedings to make sure our client did not lose the right to claim for compensation.

Resolution: The case finally settled for £40,000.00.
