Our elderly client receives compensation for injuries sustained falling down a hole in a pavement

construction worker

Our client, who is over 90 years old, was walking along their local High Street. When she passed some building works she fell down a hole in the pavement which had been left by the workmen.

As a result of the fall our client suffered from personal injuries.

Our Client’s Injuries:

Our client fractured their left wrist and received a soft tissue injury to the left knee.

How Hayward Baker Helped:

One of our personal injury specialists Ria Tallack took on this case on a no-win-no-fee basis. As the claim was of low value, Ria made the claim to the defendant insurers through the low value Personal Injury Accident Portal.

After just a few days the Defendant insurers admitted liability.

A medical appointment was then arranged, where our client was examined by an Orthopaedic Consultant who wrote up a report on the injuries.

The Valuation:

The medical report proved that our client’s injuries were caused by the incident, and enabled Ria to correctly value the claim for damages and associated losses.

The first report suggested that our client had a claim for: out of pocket expenses for travel to and from hospital appointments, care and assistance at home with household tasks, and a small claim for painkillers. There was also a small amount needed for postage and phone calls.

Ria then began to negotiate fair settlement with the Defendant insurers.

The Resolution:

A settlement figure was agreed by Ria in the sum of £3,580.80 for our client.
