Cyclist knocked off bike by a car receives compensation payout

Car knocks cyclist of her bike causing personal injuryMrs L was cycling along Knapping Hill in Harrogate when a car pulled out without warning into her bicycle causing her to be thrown to the ground causing her to suffer injury.

Her injuries were bruising and stiffness to her neck and shoulders, bruising to her left knee, back strain, bruising between her legs causing reduced mobility.

Mrs L instructed Hayward Baker Solicitors to act for her in a claim for personal injury caused by the accident.

Hayward Baker stated the claim on the insurers portal with the following allegations:

You drove out of a minor road onto a major road when it was unsafe to do so and directly into collision with our client’s bike.  You failed to keep your vehicle under any or any proper control and drove it in such a way that it endangered other road users, in particular our client.”

The car drivers insurers had 24 hours to acknowledge the claim and 15 days to make a liability decision. An acknowledgement was received with  a day and the liability decision which was liability admitted was received within 5 days.

The next thing Hayward Baker did was to arrange a medical appointment for Mrs L with a General Practitioner Consultant who would examine her and formulate a report on her injuries. This report would be used in evidence in  support of  her claim and aid her solicitor in valuing the claim.

The medical report confirmed that Mrs L’s  injuries were as a result of the material accident and that she also required a course of  physiotherapy.

It was decided by Mrs L that she did not want to settle her claim until she had undergone some additional physiotherapy as she want to make sure this had made a difference to her injuries first. This was a sensible decision to make as should she have settled the claim now and the physiotherapy had not worked then her claim could have been worth  more money but unfortunately she would not be able to go back to the insurers and ask for more money if she had accepted any earlier offer.

In the meantime Hayward Baker made a record of Mrs L’s out of pocket expenses, these are expenses incurred as a result of the accident and not the actual compensation for her injuries and suffering. A schedule of out of pocket expenses (Schedule of Special Damages) was formulated from the information given by Mrs L and this included travel expenses, replacement bicycle, care and assistance  claim which involved help with domestic tasks around her home, lifts to medical appointments. P
ainkillers were claimed for along with the costs of physiotherapy and a small amount for telephone calls and postage costs.

When the claim was finally settled Mr l received just over £4200.00 in compensation.

The claim from start to Mrs L receiving her compensation cheque took 9 and a half months which was quite quick considering that she had to undergo a second course of physiotherapy and wanted to wait until the end of this treatment before settling her claim.
