Our client suffered burns after an accident at work and receives £4,000 compensation

Our client was employed as an Industrial Cleaner and was cleaning out a heat exchange at a Senior Reservoir oil site.

Our client was in the heat exchange when hot oil escaped from one of the pipes that should have been shut off prior to his entry into the area.

Hot oil poured out of the open pipe and hit our client, knocking him off his feet. As a result of the accident our client suffered from a personal injury.

Burns to both legs were caused by the spillage.

What did Hayward Baker Solicitors do to help:

 One of our personal injury specialists Alison Spriggs who is a Fellow of the Institute of Legal Executives took on the case on a no-win-no-fee basis.

Alison stated the claim to the defendant insurers via the Ministry of Justice Claims Portal. The insurers then investigated the claim and denied liability on the basis that our client was not authorised to work on the unit.

However, Alison gathered evidence to show that our client was cleared to do the cleaning work on the unit. This meant that the firm was responsible for capping the pipe had been negligent in their duty of care to our client.

Medical reports were obtained by Alison to prove our client’s injures. A schedule of special damages (out of pocket expenses) was also drafted to include travel expenses, loss of earnings and medical expenses.

This case never went to Court as the insurers made a number of offers to settle the claim. At first these were too low for our client to accept, but after some serious negotiation from Alison a fair figure was finally agreed.

The Resolution:

Ultimately, this case was settled for £4,000.
