Care assistant who suffered an accident in the workplace is awarded personal injury compensation by her employer

needlestick injury in the workplaceA care assistant in Hampshire is awarded just under £2,000.00 when she sustained a needlestick in jury at her place of work.

Accident Circumstances: In the course of her duty as a care assistant our client was tidying the room of a resident who had recently passed away so it was ready for the family when they came to visit. As our client picked up rubbish from off the floor she sustained a needlestick injury from a syringe which had been left on the floor by another employee. As a result our client sustained a personal in jury.

Our client’s injuries: Needlestick injury to the thumb.

What did Hayward Baker Solicitors do to help: One of our personal injury specialists Alison Spriggs who is a Fellow of the Institute of Legal Executives took on the case on a no-win-no-fee basis and sent a letter of claim to the defendant, who initially denied liability for the accident but later changed their mind and admitted liability. This mean’t that provided that medical evidence confirms  that our client was injured as a result of the accident the insurers have agreed to pay compensation to our client.

A medical appointment was arranged for our client to see a  medical expert who would examine our her and then formulate a report upon her injuries. It was this report that was used by us to value our client’s claim and to prove her injuries to the defendant insurers. Medical records containing details of the accident were forwarded to the medical expert to assist them in writing the subsequent report.

Alison also negotiated settlement with the defendant insurers.

Resolution: Compensation awarded in the sum of £1,750.00 which is the lowest level as the needle did not cause any infection.
