Car driver on Isle of Wight sues for soft tissue/whiplash injury after another car collides with his vehicle

Whiplash soft tissue injuryMr L was driving along Downend Road on the Isle of Wight when another vehicle tried to cut across the road in front of him and as a result collied with his car causing Mr L a whiplash  injury to his neck and back.

Mr L wanted compensating for his injury so he instructed Hayward Baker  Personal injury Solicitors to pursue his claim for compensation. Once Mr L was signed up on a No Win No Fee basis  and a copy of the police report was applied for his solicitor stated the  claim through the on-line portal for  low value  road traffic accidents. This system allows the solicitors to state the claim directly to the insurer of the Third Party (Defendant Driver).

The insurers acknowledged the claim within 24 hours and 3 days later made a Pre Med Offer of £1800.00 to settle the claim. This meant that the insurers wanted to settle the claim now without medical evidence. Mr L’s solicitor write to him regarding the offer and informed  him that the offer was only open for 14 days after which it could be withdrawn. His solicitor also advised that without medical evidence they were unable to confirm  the exact nature and duration of his injuries that he sustained as a result of the accident. However Mr L had previously told his solicitor that he only suffered from his injuries for a few weeks and if this is still the case then the offer was reasonable. If Mr L accepted the offer then the claim would come to an end. Should Mr L wish to have a medical report upon his injuries there is no guarantee and the claim could be worth more and maybe less then the current offer.

Several days later the insurers sent notification that liability is not disputed and Mr L was informed of this and asked by his solicitor what he would like to do about the the Pre Med offer previously made by the defendant insurers. Having spoken to his solicitor on the telephone Mr L decided to accept the offer of £1800.00 and signed and returned the form of authority allowing his solicitor to settle the claim.

Mr L received a cheque from the insures 15 days after agreeing to accept their offer in full and final settlement of his claim.

This was a simple case and from the date Mr L contacted Hayward Baker  Solicitors the claim took only 4 months to reach a conclusion.
