How Hayward Baker Helped:

Hayward Baker’s client was attending an indoor play park with his child when he caught his head on a sharp protruding zip tie.

As a result our client suffered an injury to his scalp, which needed to be dealt with at the local hospital.

The Injuries:

A 10-inch laceration to the top of his head.

How Hayward Baker Helped:

One of our personal injury specialists Gary Lee took on this case on a no-win-no-fee basis.

As the claim was of low value, Gary made the claim to the defendant insurers through the Low Value Personal Injury Accident Portal.

The children’s park was liable for the accident as they failed to take any reasonable care to see that our client would be safe within the premises. The zip tie remained as a danger, and they failed to enforce any system to identify faulty features like this one.

The Defendant insurers did admit liability, and Gary then took steps to arrange for our client to be examined by a medical expert. In this case, a Plastic Surgeon was necessary.

The Valuation:

The medical evidence proved that our client’s injury was caused by the accident, and further highlighted some additional out of pocket expenses that could be claimed.

This included travel expenses to and from medical appointments, care and assistance, medicine and a loss of earnings claim for the period of sickness leave needed.

Using all of the relevant evidence, Gary then discussed a fair settlement.

The Resolution:

A settlement figure was agreed in the sum of £7950.18 for our client.
