Son seeks compensation after parents killed on level crossing

The son of an elderly couple who were killed when their car was struck by a train on a level crossing is set to make a compensation claim against Network Rail.

In September 2009, Mr and Mrs Mackay, both aged 81, and the brother of Mr Mackay, aged 66, died when their car was hit by a Network Rail train.

The fatal car accident occurred at a free and unmanned gate.

A report into the incident carried out by the Rail Accident Investigation Branch (RAIB) found that the train operator failed to understand the risks associated with the crossing.

It also found that Network Rail had failed to take a record of the previous incidents at the site, including a fatal one at the location.

The report said that various recommendations were suggested to improve the safety at the level crossing and, had proper assessments been carried out, the measures could have been implemented a lot quicker.
